Abstract: The subject of this study is some of the practical aspects of real estate construction. There is a growing number of cases arising in this respect following the entry into force of the Spatial Planning Act (in force on 31 March 2001) and the introduction of new requirements for real estate construction. An example of this are the special requirements for construction in co-owned properties that have been introduced and which should comply with the general ones under the Property Act. The case law have also considered various hypotheses related to the construction in real estates, which affect the relationship between the property's owners and those who have the right to build in their property. Special attention is also paid to the construction in cases of distribution of use between co-owners of joint properties.
